Having held a guilty plea agreement consideration hearing and a sentencing hearing in the case of Milijan Mijović et al, on 15 November 2023 the Court of BiH delivered and pronounced a Judgment, finding the accused Milijan Mijović, Mišo Miljanić and Milan Rašević guilty that, under various counts of Indictment, cited in the operative part of the Judgment, they committed the criminal offense of Organized Crime under Article 250(2) CC BiH, as read with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) CC BiH.

The Court imposed the following sentences on the accused:

• the accused Milijan Mijović, three (3) years of imprisonment, with the time the accused spent in pre-trial custody, from 1 February 2022 to 20 July 2022, being credited towards his sentence of imprisonment;

• the accused Mišo Miljanić, one (1) year and six (6) months of imprisonment, with the time the accused spent in pre-trial custody, from 1 February 2022 to 20 July 2022, being credited towards his sentence of imprisonment. The accused is also fined with 10,000.00 BAM, which he must pay within 30 days of the day when the Judgment becomes final;

• the accused Milan Rašević, one (1) year of imprisonment, with the time the accused spent in pre-trial custody, from 1 February 2022 to 20 July 2022, being credited towards his sentence of imprisonment;

The accused have been found guilty because, inter alia, from early 2020 to 2022, after D.P. organized a group for organized crime, which was joined by Milijan Mijović, Mišo Miljanić, Milan Rašević and other persons known to them, with the aim of having the organizer and group members liaise with each other and agree and link up with other persons to organize, prepare and commit criminal offenses codified by the Criminal Code of Bosnia and Herzegovina, all for the purpose of obtaining ill-gotten gain, specifically by way of illicit trafficking in narcotic drugs, so that, as the organizer and group members they committed illicit trafficking in narcotic drugs, knowing full well that they had not obtained approval from the authority in charge of the sale, transfer, purchase, keeping, transport, transfer, dispatch and delivery, during which they used mobile phones with installed applications for mutual communication, specifically designed for maintaining protected and encrypted communication, including the “SKY ECC” application, during which they agreed on the time, place and method of purchase and sale of narcotic drugs, and in direct contact agreed on the time, place and method of taking over, transporting, transfering and handing over the narcotic drugs and taking of the ill-gotten gain in cash, in the manner that from early 2020 to not later than 23 November 2021, after D.P. or one D.L. agreed on the purchase and transport of narcotic drugs with persons from Montenegro known to them, from the territory of Montenegro to the territory of BiH, the accused Mijović Milijan and Miljanić Mišo, together with other group members known to them, repeatedly carried out transport of larger quantities of narcotic drugs to the territory of BiH, and handed them over to other members of the group for further sale in the aforementioned countries and in the EU countries.

The accused Milan Rašević has been found guilty that, together with other members of the group known to him, having agreed on the sale of 5kg of narcotic drug with one D.L., he handed it over to V.K., who, on 5 March 2021, on the orders of D.P., transported the drug to the territory of Gradiška and handed it over to unidentified persons that were previously hired by one D.L., after which D.S. took over 14,000.00 EUR from one D.L. in the territory of Gradiška on account of the purchase of 5 kg of narcotic drug, which he then handed over to Milan Rašević.
